These Terms of Service (“Terms”) govern your access to and use of the PureFit website, applications, and related coaching services (collectively, the “Services”). By accessing or using the Services, you agree to be bound by these Terms and our Privacy Policy.

1) Scope

These Terms apply to your use of:

  • Our website (purefitcoach.com)
  • Web and mobile applications (when available)
  • Onboarding surveys, assessments, and check-ins
  • Online coaching communications and feedback
  • Any content, programs, features, or tools we provide

2) Eligibility

You must be at least 13 years old to use the Services. If you are under 18 (or the age of legal majority where you live), you may use the Services only with a parent or legal guardian’s permission and supervision, and they agree to be responsible for your use.

3) Accounts and Security

You may need an account to access parts of the Services. You agree to provide accurate information, keep it updated, and maintain the confidentiality of your login credentials. You are responsible for activity under your account. If you believe your account has been compromised, contact us immediately at info@purefitcoach.com

4) Coaching Relationship and Communications

PureFit provides online personal training guidance. Coaching may include written messages, check-ins, program adjustments, and feedback. The Services are primarily designed for asynchronous support (not live sessions), and response times may vary.

5) Health, Medical, and Safety Disclaimer

PureFit is not a medical provider. The Services provide fitness and educational information and are not intended to diagnose, treat, cure, or prevent any disease or medical condition. You should consult a physician or qualified healthcare professional before starting any exercise program, especially if you have a medical condition, pain, injury, are pregnant, or are taking medication.
Use at your own risk. Exercise involves inherent risks, including serious injury. You are solely responsible for your health and safety. Stop immediately if you feel pain, dizziness, chest discomfort, or other concerning symptoms, and seek medical assistance.

6) Subscriptions, Billing, and Cancellation

Some Services require payment, including subscriptions. By purchasing, you authorize us (and/or our payment processor) to charge your payment method for recurring fees and applicable taxes, unless you cancel.
Auto-renewal: Subscriptions automatically renew unless canceled before the renewal date.
Cancellation: You can cancel at any time through your account settings (if available) or by contacting support. Cancellation stops future charges; access generally continues until the end of the paid period.

7) Refunds and Trials

Unless required by applicable law, payments are non-refundable. If we offer a free trial or promotional period, the trial terms will be shown at sign-up. If you do not cancel before the trial ends, you will be charged for the subscription at the then-applicable price.

8) User Content and Permission to Use It

You may submit content through the Services, such as messages, check-ins, photos, or videos (“User Content”). You retain ownership of your User Content, but you grant PureFit a worldwide, non-exclusive, royalty-free license to host, store, process, reproduce, and display your User Content solely as necessary to provide and improve the Services, including providing coaching feedback.
You represent that you have the rights needed to submit User Content and that it does not violate any law or third-party rights.

9) Prohibited Conduct

You agree not to misuse the Services. You will not:

  • Violate any law, regulation, or third-party rights
  • Harass, threaten, discriminate, or abuse others
  • Impersonate any person or misrepresent your affiliation
  • Attempt unauthorized access, reverse engineer, or disrupt the Services
  • Upload malware, spam, or harmful content
  • Use the Services for commercial purposes without our written permission

10) Intellectual Property

The Services and all content provided by PureFit (including software, designs, text, videos, workouts, and trademarks) are owned by PureFit or its licensors and protected by intellectual property laws. We grant you a limited, revocable, non-transferable license to use the Services for personal, non-commercial use, subject to these Terms.

11) Third-Party Services and Links

The Services may integrate or link to third-party services (e.g., payment processors, analytics, hosting). We do not control third-party services and are not responsible for their content, policies, or practices. Your use of third-party services may be governed by their terms.

12) Service Changes, Suspension, and Termination

We may modify, suspend, or discontinue the Services at any time. We may suspend or terminate your access if you violate these Terms, pose a risk, or misuse the Services. Upon termination, your right to use the Services ends, but certain provisions of these Terms will continue to apply (including disclaimers and limitation of liability).

13) Disclaimer of Warranties

To the fullest extent permitted by law, the Services are provided “as is” and “as available” without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee the Services will be uninterrupted, error-free, or meet your expectations.

14) Limitation of Liability

To the fullest extent permitted by law, PureFit will not be liable for indirect, incidental, consequential, special, punitive, or exemplary damages, including lost profits or loss of data. In any event, PureFit’s total liability for claims arising out of or related to the Services will not exceed the amounts paid by you to PureFit in the PAST 6 months preceding the event giving rise to the claim.

15) Indemnification

You agree to indemnify and hold harmless PureFit and its affiliates, officers, directors, employees, and agents from claims, damages, liabilities, and expenses (including reasonable attorneys’ fees) arising from your use of the Services, your User Content, or your violation of these Terms.

16) Governing Law

These Terms are governed by the laws of State of Delaware, United States of America, without regard to conflict-of-law rules, except where superseded by applicable consumer protection laws.

17) Dispute Resolution (Arbitration and Class Action Waiver)

Please read carefully. Depending on your location, you and PureFit may agree to resolve disputes through binding, individual arbitration rather than in court, and you may waive the right to participate in a class action. If you include arbitration, specify:
(a) the arbitration provider (e.g., JAMS), (b) the venue rules, (c) a small-claims carveout, and (d) an opt-out process within 30 days.

18) Changes to These Terms

We may update these Terms from time to time. If we make material changes, we will provide notice (such as by updating the “Last updated” date or providing a notice through the Services). Continued use after changes means you accept the updated Terms.
